These Terms of Service (“Terms”) govern your access to and use of the Concrete Capital website and any authorized administrative or investor portal (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About the Services
Concrete Capital provides information and tools related to land acquisition, development opportunities, potential property transactions, and related services. Features may include public information, contact forms, private investor materials, and internal deal-flow tools.
We may change, suspend, or discontinue any part of the Services at any time. We do not guarantee that any particular feature, property, opportunity, or information will remain available.
2. Eligibility and authorized use
You must be at least 18 years old and able to enter a binding agreement to use the Services. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
Private portal features may be used only by individuals specifically authorized by Concrete Capital. Access is personal to the authorized user and may not be transferred.
3. Accounts and credentials
You are responsible for maintaining the confidentiality of your username, password, and account session and for activity that occurs through your account. You may not share credentials or allow another person to use your account. Notify us promptly if you suspect unauthorized access or credential compromise.
We may suspend or revoke access where we reasonably believe an account has been misused, compromised, shared without authorization, or used in violation of these Terms.
4. Investor portal and confidential information
Information displayed in the investor portal is confidential and is made available solely to help authorized users evaluate potential opportunities. You agree to use it only for that purpose and not to publish, redistribute, scrape, resell, or disclose it to an unauthorized person without written permission from Concrete Capital.
Portal access does not guarantee that an opportunity is available to you, that a transaction will occur, or that information will remain unchanged. Concrete Capital may limit which opportunities or fields are visible to a particular user.
5. Property information and independent diligence
Property descriptions, maps, coordinates, acreage, zoning, prices, notes, availability, development concepts, and other deal information may be preliminary, estimated, incomplete, supplied by third parties, or subject to change. Map pins may be approximate.
You are responsible for independently verifying all information and conducting appropriate legal, financial, environmental, engineering, title, survey, zoning, utility, entitlement, market, and other due diligence before relying on information or pursuing a transaction.
6. No offer, advice, or guaranteed relationship
Unless expressly stated in a separate written document, content in the Services is provided for general informational purposes and does not constitute an offer to sell, a solicitation to buy, investment advice, legal advice, tax advice, engineering advice, or a promise of financing or returns.
Using the website, submitting a form, receiving portal access, or communicating through the Services does not by itself create a brokerage, agency, fiduciary, partnership, joint venture, client, or other professional relationship. Any such relationship must be established by a separate written agreement signed by the appropriate parties.
7. User submissions
You represent that information you submit is accurate to the best of your knowledge, that you have the right to provide it, and that it does not violate law or another person’s rights. You grant Concrete Capital permission to use, store, reproduce, and share submitted information as reasonably necessary to respond to you, evaluate an opportunity, provide the Services, and conduct related business activities consistent with our Privacy Policy.
Do not submit passwords, government identification numbers, bank account information, or other highly sensitive data through a public contact form.
8. Prohibited conduct
You may not:
- Use the Services for unlawful, fraudulent, misleading, abusive, or unauthorized purposes.
- Attempt to access another user’s account or restricted information.
- Interfere with the security, integrity, availability, or operation of the Services.
- Introduce malicious code, probe for vulnerabilities, bypass access controls, or conduct automated scraping without written permission.
- Copy, publish, distribute, sell, or commercially exploit private portal content without authorization.
- Impersonate another person or misrepresent your affiliation, authority, or intended use.
9. Intellectual property
The Services, including their design, branding, text, graphics, software, and organization, are owned by Concrete Capital or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Services for their intended purpose.
Third-party names, maps, data, and services remain the property of their respective owners.
10. Third-party services and links
The Services may contain links to or rely on services operated by third parties, including mapping, hosting, database, authentication, and newsletter providers. We do not control and are not responsible for third-party services, content, availability, security, or policies. Your use of a third-party service may be subject to separate terms.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied. Concrete Capital disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted or error-free operation.
We do not warrant that property information is complete or current, that an opportunity is suitable for a particular purpose, that a transaction will close, or that use of the Services will produce a particular result.
12. Limitation of liability
To the maximum extent permitted by law, Concrete Capital and its owners, officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, loss of data, or business interruption arising from or related to the Services.
To the maximum extent permitted by law, the total liability of Concrete Capital for claims arising from or related to the Services will not exceed the greater of $100 or the amount you paid directly to Concrete Capital for use of the Services during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Concrete Capital and its owners, officers, employees, agents, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, misuse of the Services, unlawful conduct, or infringement of another person’s rights.
14. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute not subject to a separate written agreement must be brought in a court of competent jurisdiction located in North Carolina, and the parties consent to the jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms periodically. The revised Terms will be posted on this page with a new effective date. Continued use of the Services after an update constitutes acceptance of the revised Terms.
16. General terms
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. These Terms and any applicable written agreement constitute the agreement governing your use of the Services; if a signed written agreement conflicts with these Terms, the signed agreement controls for that subject matter.
